What does deportation mean?
Deportation implies being mandated to leave the country, typically prompted by serious violations such as financial fraud, criminal acts, or violent behavior. Deportation can be temporary or permanent. Permanent deportation, also called "lifetime" deportation, is linked to especially grievous cases, and the individual cannot return to the country—unless a special permit is obtained.
Legal Framework for Return
Article 18 of Federal Decree Law No. 29 of 2021 of the UAE states:
"Anyone who has previously been deported can only return to the country with the prior permission of the President of the United Arab Emirates."
This means that returning is not automatic and is only possible with approval from the Presidential Office or the appropriate federal authority.
How to Apply for Return?
The following steps are required to submit an application for a permit to return:
1. Submission of a written application: The application can be submitted to the Federal Authority for Identity and Citizenship, Port Security and Customs (ICP) or the Ministry of Interior.
2. Required Documents:
Passport
Previous UAE personal number (Emirates ID number, if available)
Copy of the deportation order
Written justification for the purpose of return (e.g., employment opportunity)
Valid job offer from a UAE employer
3. Involvement of a legal advisor: It is strongly recommended to seek the assistance of a local, licensed lawyer or legal advisor to ensure the application meets all legal and administrative requirements.
4. Authority Decision: The review of the application is entirely at the discretion of the competent authority. There is no guaranteed approval, even if all documents are in order.
What to Expect for Applicants?
Authorities primarily examine whether:
The reason for deportation has ceased
Legal rehabilitation or compensation has since occurred
The purpose of return is legitimate and justified (e.g., legal employment)
In the case of a positive decision, the individual may re-enter the country, even on a work visa. However, in the case of a rejection, entry into the UAE remains prohibited.
